1. Acceptance of Terms

These Terms of Service (the "Terms") constitute a binding agreement between you and Pro Clean & Fix LLC, a Nevada limited liability company ("Company," "we," "us," or "our"), governing your access to and use of the website located at pro-clean-fix.com, including all content, functionality, and services offered on or through it (collectively, the "Site"). By accessing or using the Site, you accept and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.

2. Eligibility

The Site is intended for use by individuals who are at least eighteen (18) years of age and by authorized representatives of business entities. By using the Site, you represent and warrant that you meet this requirement.

3. Permitted Use

You may access and use the Site solely for the purpose of obtaining information about the Company's services and submitting a request for a service estimate. You agree not to: (a) use the Site for any unlawful purpose or in violation of any applicable law or regulation; (b) submit false, misleading, or fraudulent information through the Site; (c) use any automated means, including robots, scrapers, or scripts, to access, monitor, or copy any portion of the Site; (d) interfere with or disrupt the operation of the Site or the servers or networks connected to it; (e) attempt to gain unauthorized access to any portion of the Site; or (f) reproduce, distribute, modify, or create derivative works from any content on the Site except as expressly permitted herein.

4. Estimate Requests; No Contract for Services

4.1 Submission of an estimate request through the Site constitutes an invitation for the Company to contact you. It does not constitute an offer, an acceptance, a reservation of services, or a contract of any kind.

4.2 Any price, scope of work, or schedule communicated by the Company is not binding unless and until set forth in a written estimate or service agreement executed or expressly confirmed by the Company. Descriptions of services appearing on the Site are general in nature and do not define the scope of any particular engagement.

4.3 All cleaning, maintenance, and repair services performed by the Company are governed exclusively by the applicable written estimate or service agreement, and not by these Terms.

5. Intellectual Property

The Site and its entire contents, features, and functionality, including but not limited to all text, graphics, logos, trade names, and the design, selection, and arrangement thereof, are owned by the Company or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Photographic images appearing on the Site are used under license from their respective rights holders. Nothing in these Terms grants you any right, title, or interest in the Site or its contents. You may share links to the Site.

6. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT. THIS SECTION DOES NOT APPLY TO SERVICES PERFORMED UNDER A WRITTEN SERVICE AGREEMENT, WHICH ARE GOVERNED BY THAT AGREEMENT.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, THE FOREGOING LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its members, managers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms or your use of the Site in a manner not expressly authorized herein.

9. Third-Party Links

The Site may contain links to third-party websites or resources. Such links are provided for convenience only. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party website.

10. Governing Law; Venue

These Terms, and any dispute or claim arising out of or relating to them or to the Site, shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict-of-law provisions. You agree that any such dispute or claim shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of such courts.

11. Modifications

The Company reserves the right to modify these Terms at any time by posting a revised version on the Site with an updated effective date. Your continued use of the Site after the posting of revised Terms constitutes your acceptance of the revised Terms.

12. Severability; Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding use of the Site and supersede all prior understandings regarding that subject matter.
